When we started monitoring cases of harassment and violations of the rights of women and children, we had monitored some cases during the months of January and February 2009, and by following up during the rest of the months of the year, we found that cases are constantly increasing and differ in reporting and discovering them from one region to another.

On the parts of the disease in society to be repaired; So, before reform is political, there must also be social and psychological reform for members of society in order for there to be political reform.
First: Monitoring cases of incest and fathers rape of children
During the year 2009, the association monitored (30) cases of rape within the family. These cases were severe because they occurred from parents against their children.
In 2003, the first study on incest in Egypt was published, and the resounding surprise that Majdoub launched in his writing ((incest … the devil in our homes)) was subject to the results of the first scientific study on the crime of incest applied to 200 cases of those who fell into this crime ; It was reported over a period of five years before 2003, and added to it a number of unreported crimes, but he learned that they had occurred from the women victims themselves, as well as from the male victims who contacted him through intermediaries, seeking to find a solution to what they were suffering because of the relationship. The mother did not believe what she heard from her daughter, who did not go beyond her second decade, that her father had sex with her without her will. Based on the mission of the National Association for the Defense of Rights and Freedoms, which lies in the Egyptian citizen living a free and generous life in his country; Enjoying all his economic, social and cultural rights, as well as his civil and political rights stipulated in the constitution, law and international covenants in a safe society; He believes in himself and his family. And in order to achieve the mission, the association had to issue a number of reports through which it monitored the phenomena that have become strange to the Egyptian society, such as the spread of the phenomenon of community violence and domestic violence during 2008, and the association issued some recommendations that it considered that through it it is possible to reduce this phenomenon.
The association continued its work when it monitored the incidents and community news in an attempt to make a comparison between the societal violence that affected the stability of the Egyptian family, which was referred to during the two years and was the major catastrophe that was not taken into account and was not prepared or anticipated. A crime in itself is one of the most heinous crimes that can be committed by human beings or committed against human beings. It is the crime of incest and the rape of fathers of their sons, sisters, or mothers … etc And often the crime ends either with another crime such as murder or keeping the crime a secret for fear of society’s gaze or silence about it on the basis of (that our Lord ordered covering up) or for other reasons that will be listed in the report. And while we, as civil society, associations and human rights centers, we demand an end to the cases of harassment that happen to our daughters and children in the street, we have found that there is worse than harassment and more severe than murder that happens to our children inside our homes and in some cases without mothers and fathers. Yes, it happens in the house, which is the symbol of security and safety, and for those who are supposed to protect and protect their children
It was necessary to stand in front of this ugly phenomenon and answer the question: Why is it happening ?? And in the interest of who and what are the opinions of specialists in society about what has been monitored and what role the government plays in such cases and does the government this time bear full responsibility for what happens or are the citizens who often throw all the mistakes and disasters on Government responsibility.
Knowing the problem that we are suffering from is good, and we must develop solutions to the problems that encounter our lives, even if they are thorny problems such as the one in our hands now. The treatment of the problem is not by hiding it and working ourselves, not seeing or without problems, but rather we must raise it and discuss its causes and effects, and that We strive to find solutions for it.
In this report also, the National Association for Defending Rights and Freedoms sheds light on the subject of the heinous crime, which is the crime of incest in the law, and the legal status of the rape of children by parents, and the position of the son who is born from his sister or uncle to whom is his lineage proven ?? And his legal status and how society accepts children resulting from such situations (in the event that they were brought up among their families or in a reformatory and went out into public life after reaching the legal age) and about the mixing of genealogies that occur as a result of that; And how does society accept and regard the son of fornication as a son of forbidden action even if he was raised and grown and became a good member of society until the inferior view of him could turn him into an old criminal in crime taking revenge on society to punish him for a sin he did not commit and did not have Entered it.
After that, the report deals with some of the causes that have been monitored that lead to the occurrence of such crimes, the opinions of psychiatrists and sociologists about what is happening, the mechanisms by which we are able to address that phenomenon and what is the role each of us has to play.

And in this year, according to the reports issued by the competent authorities, the state of poverty increases from year to year, and thus the crime rate rises from year to year.
For example, any individual, especially in slums, who wishes to marry, builds his nest or rents a room in which he marries and gives birth to children randomly and without planning for the future, and thus gives birth to seven or eight children who are in full view of what is happening between their parents from a legitimate relationship Of course, they grow up and do not have any limits in their relationship, and they often tend to imitate, and the first to imitate with them are their sisters !!!!
Poverty in most cases among families who are better off than the previous ones leads to a delay in the age of marriage and the accompanying psychological disturbances and feelings of frustration, unhappiness, misery, and the desire to take revenge on anyone to empty the stored charge inside them in anything because of the failure to achieve their ambitions Or build a family.
Poverty made members of the same family each one seek his condition without asking his brother, and they met by chance. A and that every member of the family marries and stays in one room in the family home, and of course each of them goes out to work and other siblings or cousins ​​reside in the house without supervision, and the disaster will happen !!!

Social reasons.

One of the social reasons cited by doctors and sociologists is a major and fundamental reason for educational methods, to name just a few
Parents’ negligence in taking care of their children, some parents believe that children in the early stage of youth need less care and accompaniment, and that they can manage their affairs more efficiently than in childhood, and parents are preoccupied with other concerns, and leave the children to manage and arrange their lives or their affairs, as if the father’s job The mother will only provide food, clothing and expenses
– Others depend on the principles and morals that they instilled in their children when they were young, and they overlook the impact of the evils in society on their children, and the influence of bad companions on them, because these pests are capable of killing what the parents planted, unless the parents pledge to take care of them until the plants bear fruit. Rather, the bad friends group may be responsible for guiding children to another deviant path in the absence of dialogue, understanding and communication between parents and children.
– Lack of role models and ideals for young people, living in a state of Too Han, lack of culture, and the absence of bridges of trust between generations and some.

Psychological and pathological causes.
Some psychiatrists have emphasized that some of the reasons that led to the emergence of such cases were that the perpetrator was a psychiatric patient or that he carried out this criminal act as a form of revenge even on himself or that he was even under the influence of drugs.
Or that the perpetrator is a criminal, psychologically perverted person, who is sexually repressed – often – and finds his desired means in a weak person who is unable to confront him.
Dr. Muhammad Al-Mahdi: Consultant Psychiatrist says: There is agreement in all religions and in most laws and cultures to prohibit and criminalize incest and other sexual harassment, or indecent assault, for many reasons, the most important of which is that the family is the basic building block of social life. The mother, sons, daughters, uncle, maternal uncle, grandfather, etc., within the framework of a value, ethical and practical system that ensures that these roles are well performed in a way that leads to healthy and harmonious development for all family members on the physical and psychological levels and
Social and spiritual. Incest weight leads to overlapping and distorting roles, to the disruption of the family system, to the downfall and collapse of the moral and ethical balance, and to the cracking of parental codes, so that the daughter becomes like a wife to her father, a traitor to her mother, and a stepmother to her brothers, or a son becomes a husband to his mother, a peer to his father, and a husband to the mother of his brothers, and severe polarizations occur. And the satellite channels open to the world led to the absence of any kind of censorship over the works presented, and the family, while watching those channels, became an encounter with scenes that stimulate instincts and open the door of the devil.
2- The absence of culture and the lack of awareness, and the tradition has become blindly carried out simply because of imitation without distinguishing between right and wrong, since we took from the West the worst of it.
3- In addition to (mobile phone) mobiles that have become in everyone’s hands after the market invaded Chinese mobiles with their cheapness and the possibility of filming with them and transmitting pornographic films and some sexual clips on Bluetooth between friends or even non-friends; Rather, everyone is competing to bring the new clips as a kind of cleverness, sluggishness, and roseness that is widespread among young people these days without supervision.
4- The technological revolution in the world of the Internet, which has become inside every home; And the spread of pornographic sites and their use is a censorship role behind doors in closed rooms and becomes a time bomb, especially among brothers if there is no censorship.
All these factors led to the spread of crimes and others, which led to the spread of such crimes and other crimes, which may be revealed by time that did not exist previously and we did not hear about them.

Violence alone is no longer the predominant feature in society now, but it has been moved to a greater and deeper stage than just the issue of beating or violence, it will be surpassed by disgraceful crimes. If it increased more than this limit, it would destroy all of humanity.

Incest in the constitution, national legislation and international charters

The law is the one that gives the right to its owners, and it is the one that deters the outlaw, but it was set for outlaws and sinful criminals in the right of society and the leaders of the law. They did not imagine that there could come a day when a father would trespass on his daughter and not the boy against his mother and commit such a crime and for that They did not put a chapter or an explanation for this situation, and accordingly, we can apply to it the provisions of Egyptian law regarding rape and indecent assault.
Indeed, the Legal Aid Unit of the National Society has searched for articles criminalizing this act and the punishment associated with it. We also worked hard until we reached the opinion of Islamic law and Christian law in this situation and the ruling of both of them in the case of a father who raped his daughter and gave birth to her brother and son at the same time.
Chapter Four of the Egyptian Penal Code contains the penalties prescribed for the crimes of indecent assault and corruption of morals. The materials were monitored as follows:
Article (267) – ((Whoever has sexual intercourse with a female without her consent shall be punished with life imprisonment or temporary hard labor; if the perpetrator is one of the assets of the victim, or someone who has been raising or observing her, or someone who has authority over her, or he is a paid servant with her or those mentioned above, he shall be punished with life imprisonment) )
Article (268) _ ((Whoever violates a person’s honor by force or threat, or attempts to do so, he shall be punished with hard labor from three to seven years.

This is an explanation of the severe punishment provided by the Egyptian law for those who carry out this despicable act, and from here we see that Egyptian laws are able to confront this phenomenon firmly and forcefully, but something important remains for the people, if such a painful incident occurred in their families by taking the initiative to report the perpetrator and To take precautionary measures to defend the victims, because in this case they are in a worse situation and need special attention and care, otherwise they have turned into a fatal and destructive monster for everything around them, because in this case they either marry and cannot live with her husband normally And he is stable and therefore resorted to salvation from him, either by killing or otherwise, that in one case there was an incident of raping a young girl, who was 9 years old, on the part of her father, so she fled to the street and found her one of the women and took her and raised her and educated her, then her wife, of course, found the girl who She became a wife that affected herself from what happened to her in the past, and she could not live with her husband, who did not know and used to treat her very roughly, and on one occasion she killed him and the accusation was not proven against her. After that, she went out to avenge the community and killed 7 men she was getting acquainted with and deluding them with of her love for them, then she kills them until her matter was discovered and she was sentenced to death.

The National Association for the Defense of Rights and Freedoms sent a letter to the Egyptian Dar Al Iftaa to know the opinion of Islamic law in a documented and official way because it is the only body with legitimacy regarding the opinion of religion on a specific issue, and this is why the response came to us on the subject of incest

Section Three:
Incest and its rule in Christian law
After completing the (National Association for Defending Rights and Freedoms) the final work of the 2009 report of rape of rape cases and statistics of incest cases and their monitoring and cases of rape of children in Egypt, I decided to put the view of religion and Christianity in the report to know the rule of religion in cases of incest rape, especially the religion ruling on the raped girl, the newborn, and the rapist So it was agreed to go to churches to take this fatwa and add it to the report, so we made the question about the fatwa and its content as follows (The father raped his daughter and remained in a forbidden relationship with her for five years until she became pregnant and gave birth to a child from him, what is the ruling on the child? And for whom is the legal ruling? The daughter, Sharia?) So the Research Unit and Social Workers of the Society (the researcher Marwa Tokal Zeinhom and the researcher Shaima Shawqi Abdullah) went to the Virgin Mary Church with the messengers seal in the pyramid and we were interviewed with the Pope in the church and we presented him with the question of the fatwa, and after he read it very carefully, he was surprised first and told us that these incidents It is not expected to happen, but we explained to him that the National Society for Defending Rights and Freedoms is working on this report and has monitored many cases that have already occurred and discussed We were informed about this issue and about the father’s relationship with his daughter and her mahrams. In the end, he explained to us that we have to go to the Church of the Great Martyr Mar Gerges in Murad Street in Giza to take the fatwa from there because he cannot submit a fatwa on this issue because it is a very important topic and it is not permissible for him to issue a fatwa on it. Indeed, I was directed Researcher Shaima Shawky Abdullah to the Church of the Great Martyr Saint Gerges on Sunday, and I did not know that this day is the day of prayer, and the security received me and set a date for the Pope to meet us on the same day, but at the same moment another person spoke to me from the church and took me to the official in the church and this actually helped me The person responsible is to speak with our master by phone because it is forbidden to meet him personally or to mention his name, and I actually read the question to him by phone and he responded to me and she answered him as follows: –
* Regarding the ruling on the girl who was raped from (father-maternal-uncle-brother), this is an incest that she is completely removed from her family and her family, and she is married to someone and lives with him and does not return to her family until the end of life
* Regarding the rule of a child who is born, adopted by any other family, this family has a problem with childbearing and needs to raise and care for this child, provided that the child is cared for and taken care of, or placed in any child shelter or nursing home.
I wrote the fatwa on the phone and thanked him for speaking to me on the phone, and I left the church, heading to the association …

 

Fourth Theme: Conclusion
When the National Association for the Defense of Rights and Freedoms monitored not a few cases of incest in Egypt, we did not believe the disintegration of the Egyptian family’s machinery of course, not all Egyptian families, but when we look at the number of cases and the ugliness of cases, we must raise the alarm and raise our voices loudly to study the case. The current Egyptian family, which was set by example in cohesion and religiosity, whether it was Muslim or Christian.
In this report, we tried to monitor the causes from our point of view as well as from the viewpoint of scholars and books that were specially written for the study of incest, as stated in the famous book (The Devil in Our Homes), which dealt with many of the causes that lead to this moral disaster.
From here we wanted to draw the attention of society and officials in Egypt to this phenomenon, and we hope to find quick and real solutions to alleviate the phenomenon of incest, but we must follow some steps in order to reach solutions, which are as follows: –
1 – Establishing a research center specializing in the conditions of the Egyptian family and that an independent budget is approved for the center to spend on family research only, especially for families who fall below the poverty line, and the center is separate from the National Center for Social Research.
2 – Limiting the random areas in Egypt and limiting the number of families who live in one room only, and the father, mother, and sons sleep in it, girls and boys, which causes this matter and in many cases leads to incest and many other problems.
3 – The correct education of children, their learning and correction, and the good attention and control of parents to protect their children from deviation in any form.
4 – All dazzling informational materials presented to our children that are not appropriate for the age of the children must be studied in order to help the family monitor and educate their children.
5 – The Egyptian government should provide human housing for families in the slums, and provide them with quality education and a safe street for every girl and child.
6 – Activating the role of the Egyptian civil society in the Egyptian street to set real plans to raise the Egyptian family’s awareness of all the problems that the Egyptian family faces every day.

So water for adultery is wasted, meaning it has no value, so it does not result in proving the lineage of the child to the adulterer: He said in the Indian fatwas: [And if a man committed adultery with a woman, then a child came and called him the adulterer, his lineage was not proven from him, but the woman should prove his lineage from her] Oh. The relationship of parenthood is a legal relationship, not a natural one. As for the maternal relationship, it is a natural relationship that proves to the one who gave birth in any way.
Accordingly, the child who resulted from him this sinful relationship between father and daughter is her son, but not attributed to her father.
He can be given any fictitious name that does not apply to a specific one. His mother inherits and inherits him, and his brothers and sisters inherit from her – whether they are or they find a future – and they inherit it; And prove between them all the rights and duties of the son and his mother and vice versa.
